1. Acceptance of Terms
By accessing or using Kormex AI (the "Service"), operated by Kormex AI ("we", "us", "our"), you ("you", "Customer") agree to be bound by these Terms & Conditions and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that entity.
2. The Service
Kormex AI provides a team of AI agents ("K-Team") that help enterprises plan, create, publish content, capture leads, and report across Mexico, the United States and Canada in English, Spanish and French (Canadian). Features include, without limitation, a trilingual content calendar, lead scoring, review monitoring, trade-compliance assistance, and connectors to Google Business Profile, Facebook and Instagram.
- The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation.
- AI-generated content is produced automatically and may contain inaccuracies. You remain solely responsible for reviewing and approving any content before it is published.
3. Accounts & Trials
You must provide accurate account information. A 14-day free trial is offered with no payment card required. After the trial, continued use requires an active paid subscription processed through our payments provider. You are responsible for safeguarding your credentials and for all activity under your account.
4. Acceptable Use
You agree not to: (a) use the Service for unlawful, deceptive or infringing activity; (b) publish content that is hateful, harassing, defamatory or violates third-party rights; (c) attempt to reverse-engineer, resell or overload the Service; or (d) connect social accounts you do not own or are not authorized to manage.
5. Third-Party Integrations & Platform Terms
When you connect Google Business Profile, Facebook or Instagram, your use is also governed by those platforms' terms (Google Terms of Service, Meta Platform Terms, Instagram Terms). We access only the data scopes you authorize. We comply with the Meta Platform Terms, including providing this publicly accessible data-deletion request mechanism at kormexai.com/data-deletion.
6. Intellectual Property
We retain all rights in the Service, software, designs and trademarks. You retain ownership of content you provide and content we generate for your account. You grant us a limited license to process your data solely to deliver the Service.
7. Payments & Refunds
Fees are billed in advance on a monthly basis in your selected currency (CAD, USD or MXN). Except where required by law, payments are non-refundable. We may change pricing with notice; changes apply to subsequent billing periods.
8. Limitation of Liability
To the maximum extent permitted by law, Kormex AI shall not be liable for indirect, incidental, or consequential damages, or for any loss of revenue, data or profits, arising from your use of the Service. Our aggregate liability shall not exceed the amounts you paid in the three (3) months preceding the claim.
9. Termination
You may cancel at any time from your dashboard. We may suspend or terminate access for breach of these Terms. Upon termination we will delete or anonymize your account data per our Privacy Policy and the applicable platform terms.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the Service or email. Continued use after changes take effect constitutes acceptance.
